1. Who we are
Summitly is a real estate technology platform operated in association with Coldwell Banker Summit Realty, Brokerage, a real estate brokerage registered under the Trust in Real Estate Services Act, 2002 (TRESA) and regulated by the Real Estate Council of Ontario (RECO). The Services include property search, automated home value estimates, calculators, market content, and Zara, our AI real estate assistant.
2. Eligibility & accounts
You must be at least the age of majority in your province or territory to create an account. You are responsible for the accuracy of the information you provide, for keeping your account credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use. Authentication is provided through a third-party identity provider; your use of it is also subject to that provider's terms.
3. Listing & market data (MLS®)
Property listing information is provided under licence from the Toronto Regional Real Estate Board (TRREB) and other real estate boards and third-party sources. This data is provided for your personal, non-commercial use, may not be copied, redistributed, scraped, or used to build a competing database, and may be subject to additional rules including the requirement to sign in to view sold or historical data. While we strive for accuracy, listing data is supplied by third parties, may be delayed or contain errors, and is not guaranteed. Always verify details with the listing brokerage before relying on them.
4. AI features, estimates & automated tools
The Services include automated and artificial-intelligence features, including Zara (our conversational AI assistant), automated home value estimates (AVMs), mortgage / affordability / closing-cost calculators, neighbourhood insights, and other AI-generated content (collectively, "AI Features"). You acknowledge and agree that:
- AI Features are provided for general informational purposes only and are not professional, legal, financial, mortgage, tax, investment, or real estate advice, and do not create an agency or fiduciary relationship.
- Automated home value estimates are computer-generated approximations, not appraisals or opinions of value by a licensed appraiser or REALTOR®. They may differ materially from a property's actual market value and should not be relied on for buying, selling, lending, or other financial decisions.
- AI-generated responses may be inaccurate, incomplete, or out of date and can produce errors. You are responsible for independently verifying any information before relying on it, and for consulting a qualified professional (a REALTOR®, lawyer, mortgage agent, or appraiser) for advice specific to your situation.
- Do not submit confidential, sensitive, or third-party personal information to AI Features. Inputs and outputs may be processed by third-party AI service providers and may be used to operate and improve the Services as described in our Privacy Policy.
- You may not use AI Features to generate unlawful, infringing, discriminatory, or misleading content, or to attempt to reverse-engineer, train competing models on, or circumvent the Services.
5. Acceptable use
You agree not to: use the Services for any unlawful purpose or in violation of TRESA, RECO rules, or real estate board rules; scrape, harvest, or bulk-download data; misrepresent your identity; interfere with or disrupt the Services or their security; upload malicious code; or use the Services to harass, defame, or infringe the rights of others.
6. Intellectual property
The Services, including their design, text, graphics, software, and the Summitly and Zara brands, are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Services for your personal, non-commercial use. All other rights are reserved.
7. No professional advice
Content on the Services — including market reports, guides, calculators, and AI Features — is for general information only and is not a substitute for professional advice. Real estate, mortgage, legal, tax, and financial decisions should be made with a qualified, licensed professional. Nothing on the Services is an offer, solicitation, or recommendation to buy or sell any property or security.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any information (including listing data and AI outputs) is accurate, complete, or current.
9. Limitation of liability
To the fullest extent permitted by law, Summitly, Coldwell Banker Summit Realty, and our affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Services or reliance on any content or AI output, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless Summitly and its affiliates from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
11. Third-party links & services
The Services may link to or integrate third-party websites and services (for example, mapping, analytics, identity, payment, mortgage, and AI providers). We are not responsible for their content, practices, or availability, and your use of them is governed by their own terms and privacy policies.
12. Privacy
Our handling of personal information is described in our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
13. Changes & termination
We may update these Terms from time to time; the "Last updated" date reflects the most recent version, and continued use after changes constitutes acceptance. We may suspend or terminate access to the Services at any time for conduct that violates these Terms or applicable law.
14. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts of Ontario have exclusive jurisdiction over any dispute, subject to any non-waivable rights you have under applicable consumer-protection law.
