Under Ontario's Mortgages Act a lender can sell a mortgaged home without going to court, but only after the borrower has been in default for at least 15 days and a notice of sale has been given at least 35 days before the sale. Until the sale, the borrower can stop it by paying the arrears and the lender's costs, and during the notice period the lender cannot take other enforcement steps without a court order.
